Resumen

El derecho laboral permite ubicar el estudio del docente como subordinado de la entidad estatal. Si bien es cierto el régimen magisterio es objeto de amplio estudio, esta monografía está enfocada a tratar lo relacionado con las pensiones. Para entender este mecanismo de protección social se parte del contexto histórico, ya que este aporta al régimen legal, generando diferentes modelos de pensión que rigen en consideración de la fecha de ingreso a la misma. En relación a los regímenes legales, no se puede imponer un límite en el estudio colombiano, por lo que también será importante la comparación de las pensiones con otros países, y de ese modo encontrar posibles soluciones.. Después se planteará una propuesta que permita implantar un mecanismo idóneo, acorde a los principios del derecho laboral y de la seguridad social que reconozcan el derecho de las pensiones de los maestros en Colombia.

Abstract

The Labor law as a tool for comparison in the contractual relationship between employer and employee, allows to locate the study of the teacher, as a subordinate of the state entity, as a subject of rights and obligations. While it is true the teaching system is the subject of a comprehensive study, this monograph is focused directly to treat related to the pensions of teachers. To perform this analysis should clarify that understanding this mechanism of social protection, it must start from the historical context, as this has strengthened the legal regime, which has generated different models of pension depending on the date of entry into the pensions system. In relation to statutory schemes, can not provide a limit in the Colombian study, which will also be important to compare pensions with other countries thereby possible solutions or examples that can not be assimilated into our territory. After all the previous exhibition, a proposal to put in place an appropriate mechanism, true to the principles of labor law and social security that recognize the right of the pensions of teachers, not only in Colombia, but was raised also pillar is based on the implementation of this project in other countries with similar problems.
