Legal actions for environmental protection are an alternative to achieve the adoption of public policies to reduce and control pollution of rivers and degradation of the watersheds, that is an increasingly common and complex world problem involving breach human rights. This paper analyzes the case of Bogota River watershed, for which there was a Court ruling that included a comprehensive strategy for its recovery. This work develops a theoretical reflection from the content thereof, and from secondary information and results of a semi-structured survey on the municipalities of the watershed as well. This case demonstrates that some strength arises when an environmental conflict is taken to court, as it gives the opportunity to bring together stakeholders and promote joint solutions. It also confirms the importance of collective action as a means to promote the formulation of public policies and measures for protection of the environment and of the collective and fundamental rights of the community.

This article explores the singularities of Kichwa-Otavalo migrants in Bogota. With seventy years of historical presence in this city that includes continual relationships not only between people in Colombia an Ecuador, but at the worldwide level as well, this population constitutes a complex and significant case for migration studies. On the one hand, it raises the question of transnational relations where the “place of origin” has been dislocated through secondary foci around which the population is articulated. On the other hand, it illustrates the importance of migratory networks with respect to recognition by the state. Thus, we show different forms of integration into the city and suggest that a central determining factor of living conditions in the city is tied to people’s relative position to established migratory networks.

Modern society has been saturated by countless environmental conflicts that cause a flagrant violation of human rights. This article focuses on Interinstitutional Environmental Agendas as an appropriate instrument for the resolution of such conflicts through the construction of agreements between the stakeholders involved. Based on theoretical considerations and analysis of the implementation of an interinstitutional environmental agenda in an area of paramo located in the township of Soacha (Cundinamarca), the purpose is to provide methodological and conceptual elements and propose steps that should be considered for the implementation and execution of this instrument.

Deep down, is a combatant in a guerrilla group and in a paramilitary group the same kind of person? The evidence suggests that the two have different types of experiences in war and processes of socialization, and one would expect different behavior from the two after demobilization. In this study, we show that the members of guerrilla and paramilitary groups in Colombia are moved by clearly distinguishable motivations in theirdecisions to join their respective groups, in which contextual conditioning factors are mixed with different logics at the personal level. Background. Within their work school counselors have to deal with the educative inclusion of students with disabilities, nevertheless, their perception of their competences is unknown in order to perform this task. Objective. To evaluate the perception of school counselors regarding their competence to guide students with different types of disabilities. Materials and Methods. This is an observational descriptive study with a transversal type, applied in a population of 235 counselors from Cundinamarca and Boyacá, representing the total counselors population. They were asked a questionnaire presenting five Likert methodology statements, regarding their own capacity to interact with students with physical, sensorial, mental and cognitive disabilities, and emotional problems. Results. Counselors’ characteristics are described taking into account criteria like gender, age, career and the number of students with disabilities that are studying in the institutions they work for. 41 % of the counselors state they are not prepared to orientate children and adolescents with physical disabilities, whereas 37.7 % state they are no prepared to orientate children with sensorial disabilities, 65.3% to orientate students with any mental disability, and 67.7% affirm they are not prepared to orientate students with any cognitive disability and just 9.9 % have difficulties to deal with emotional problems. Conclusions. School counselors realized having a low preparation to orientate students with different disabilities, which could restrain an adequate educational inclusion.

Some years ago, several legislative and jurisprudential changes have taken place that affect the protection of collective rights created in the Constitution and in the Law 472 of 1998. This article aims to analyze how these changes, specifically related with the precautionary measures and the prerequisite to demand in popular action, imply a problem in the protection of the citizen’s human rights as a constitutional guarantee. For this, the methodology was based on the revision of the historical antecedents of the popular actions, followed by a study of the norms and jurisprudence that refer to the mentioned modifications and later, was made a dogmatic analysis of the social and political effects that generate such changes. In accordance with the proposed objectives, it is concluded that there is a lack of awareness of the importance that the Constituent gave to the protection of collective rights and popular actions, as a mechanism for citizen participation. Also is evident that there is a tension between two rules in the legal system, which places the citizen in the middle of a procedural discussion taking him away from the real nature of such actions and implies a specialized knowledge for the exercise of them.

The development of mining activities generates tensions between the interests of the central level of the State and local territorial entities, as the latter have to deal with the environmental, social, and cultural consequences of the extraction. This has caused, on one hand, a legal debate on the prevalence of the principles of the Unitary State, and the public and social interest of the mining industry; on the other, the territorial autonomy, and the public and social interest of the environment. This reflection article clarifies the role that territorial entities play in the adoption of decisions related to the mining activity, based on the analysis of the regulatory, legal, constitutional, and case law developments on the subject matter. This shows evidence that territorial authorities have several legal tools that allow them –and, in some cases, impose onthem the duty– to actively and efficiently take part on the adoption of authorizations to carry out mining activities in their jurisdiction, which is in line with the coordination, attendance, and subsidiarity.

This article examines access limitations faced by physical and motor disabled people (PCD) in public and private educational institutions in Colombia. As explained in the paper, this phenomenon is associated tohuman discrimination and violates all national and international provisions established to protect people’s rights in terms of social inclusion, free movement, education, and access. Departing from this situation, this report analyzes the legal status of PCD in Colombia, including both a careful identification of their rights as well as State’s obligations. Grounded on this analysis, this study concludes that regardless of the existence of norms to protect this group´s rights, including access to schools and universities, specific actions and methods to protect them have not been effective. To meet the research purpose, this study selected thirteen rulings handed down by the Constitutional Courtin Colombia concerning general and educational access for PCD. Additionally, the study concludes with the analysis of national regulations dealing with specific rights for PCD, as well as the technical standards and norms related to access in Colombia.

This article seeks to reflect on the recognition of guarantees to groups of special protection that has had an impact on the legal construction of a special category of subjects. The purpose is to show how the recognition of those “subjects of special constitutional protection” has taken relevance with the Political Constitution of 1991 and its interpretationby the Constitutional Court. From a descriptive and interpretative approach at the international level, advances have been made from the protection of ethnic minorities to the specific recognition of other subjects, which is influencing the Colombian legal system that recognizes groups of special protection either for “conditions of manifest weakness” or for the position of ‘helplessness’. Jurisprudence has represented the greatest advance so the State will be responsible for the affirmative actions for the protection and special guarantee of these subjects and their rights in application of the principle/right to equal opportunities and non-discrimination.

In Colombia, Law 1010, 2006, regulates the correction, prevention, and penalization of mobbing. In spite of the law, in practice it is not very effective the access to justice for victims of mobbing, as evidenced in few denounces and few penalizing sentences. In this reflection article, juridical and material barriers which prevent the access to justice in mobbing are analyzed, which results are part of the project “Practices of Mobbing and the way how they are solved in a juridical way Colombia,” carried out by Sociology and Jurisprudence researchers of Universidad del Rosario.

Introduction. The phenomenon of the consumption of psychoactive substances (SPA) needs to be approached from the complex given that there are no linear deterministic models that can explain it. SPA use requires for its understanding, the approach from different levels of reality to better understand the barriers of access to health services. Objective. This article identifies and analyzes, from the complexity, the existing barriers of access to services for SPA users by health providers in the Colombian Health System. Methodology. This is a transdisciplinary and qualitative research, involving providers of the health system treating people with SPA. Three regions were selected. In each region, technical assistance, social cartography, focus group and thematic questionnaire were performed. Results: Barriers of access to services were identified that included administrative barriers in differential approach, and recognition ofhuman rights of SPA consumers as subjects of special protection. Conclusions. Its recommended to understand the problem of SPA from an interdisciplinary perspective that can allow to enhance at the local level, the human rights approach in the provision of health services to SPA consumers.

Emotional processing (EP) is crucial for the elaboration and implementation of adaptive social strategies. EP is also necessary for the expression of social cognition and behavior (SCB) patterns. It is well-known that war contexts induce socio-emotional atypical functioning, in particular for those who participate in combats. Thus, ex-combatants represent an ideal non-clinical population to explore EP modulation and to evaluate its relation with SCB. The aim of this study was to explore EP and its relation with SCB dimensions such as empathy, theory of mind and social skills in a sample of 50 subjects, of which 30 were ex-combatants from illegally armed groups in Colombia, and 20 controls without combat experience. We adapted an Emotional Recognition Task for faces and words and synchronized it with electroencephalographic recording. Ex-combatants presented with higher assertion skills and showed more pronounced brain responses to faces than Controls. They did not show the bias toward anger observed in control participants whereby the latter group was more likely to misclassify neutral faces as angry. However, ex-combatants showed an atypical word valence processing. That is, words with different emotions yielded no differences in N170 modulations. SCB variables were successfully predicted by neurocognitive variables. Our results suggest that in ex-combatants the links between EP and SCB functions are reorganized. This may reflect neurocognitive modulations associated to chronic exposure to war experiences.

This article aims to review how the elements of clinical legal education, whose origins can be traced back to other countries, have allowed the structuring in Colombia of spaces for practical and academic training of law students, and at the same time, have provided the necessary tools to meet the legal needs of disadvantaged communities in social environments that constitute the reality of the future lawyer. Based on the experience of the legal clinic of the Rosario University, which traces its origins to the year 1999, it will show how the elements of the clinical model allow students to know their reality, explore their knowledge and to help others, training them with a social responsible conscience of their profession and teaching them, from various traditional methods, to implement the knowledge acquired in their professional career. The review of clinical models will allow to assess its advantages, purposes and contributions as a pedagogic tool to contribute in this way to its consolidation in Colombia, not only from the strengthening of existing clinics, but also from the consolidation of new academic spaces of practical training.

This article as part of a research work that analyzes the role of legal clinics at the Ibero-American universities, aims to present the perception of clinical teachers and students about the needs, functions and challenges of clinics in legal training. It begins with a conceptual and historical presentation that allows to dis- tinguish and recognize the evolution of clinical legal education movement in Ibero-America. Later, assess the model in six countries (Argentina, Chile, Colombia, Mexico, Peru and Spain). Was used SWOT methodology, from the perception of clinical teachers —obtained through the implementation of interviews in depth— and the perception of students that integrate or have integrated legal clinics in Latin America —with a survey he article finishes with conclusions, seeking to highlight the main challenges, and above all, the need to reconsider and assess the methodology of clinical legal education as an integral pedagogic educational tool.

Compared analysis about the Spanish and Colombian normative systems that aim for the women’s rights protection for addressing gender-based violence. The goal of this study is to build proposals that reinforce the existent instruments and allow sharing good normative practices. The advances in regulation and institutional reinforcement impulsed by women organizations can be underlined, and the actions that fortify the confidence in the procedures are highlighted, because they stop the re victimization and assure the accomplishment of the normative frameworks.

Worldwide and particularly in Latin America, non-mechanized or manual mining has been a means of sustenance for rural populations or for city migrants who move looking for work in these areas, both living in unfavorable social conditions; it is, therefore, necessary to recognize the socio-legal aspects surrounding this activity. To accomplish this, we conducted a descriptive research on three dependent variables: conceptualization, mining legality and formality. We obtained this data through interviews with mayors, three field visits and a comparative analysis of mining laws in 23 Latin-American countries. We found this activity to be essentially rudimentary, carried out in an area of no more than 20 acres with a production does not exceed five tons per worker/day. Non-mechanized mining has been stigmatized and persecuted by the adaptation of rules benefiting large-scale mining and regulations that do not differentiate between small-scale mining, usually mechanized, and manual mining. Ultimately, we found that several Latin American countries require these small operations to adhere to the same conditions as large-scale mining projects, forcing non-mechanized miners to carry out their activities illegally and maintain their livelihoods.

This article argues that agendas of negotiation in peace processes are good indicators for the presence of factors that lead to success in the attempt of bringing armed conflicts to an end. While literature suggests a series of psychological and contextual elements that may help explain the outcome of a peace process, this article demonstrates the usefulness of incorporating the agendas as part of a systematic study. Hence, it presents results of the analysis of 83 peace processes developed between 1989 and 2012, describing the technical and political topics discussed by the parties and identifying trends in terms of times, geography, nature of the conflict, and outcomes. Finally, the paper shows that discussion of topics such as transformation of rebel organizations into political parties, or their integration into the national armed forces, are related to a higher probability of success in the process.

This article presents the results of a reflection made under the International Human Rights law, the European and Inter-American human rights protection systems, and the Universal law, all in relation with any rights that may be considered a limitation of the sovereign power of states to define their migration policy. Also, it deals with the principle of equality and nondiscrimination of foreigners, the discretion of States to define their migration policies, and analyzes that this principles may constitute a limitation to the sovereignty of states.

This article presents a research that demonstrates the seriousness of the situation of violence against women in intimate relationships. The contribution of the research lies in the collection of figures from regional centers in Cali, Pasto and Cartagena, which refer to the main problems identified, and dynamics of violations, types of offenders, forms of violence and even periods when these phenomena are increased. It ends with some proposals concerning the strengthening of public policy, state and institutional response mechanisms, and designing of access to justice for women, given the serious situation described in intimate partner violence in the context of domestic violence.

The evolution of the concept of disability has moved from a biomedical focus to a human rights focus in the last years. The human rights focus regards people with disabilities’ individual features with relation to their social, cultural y physical context. The interaction conditions between people and their context determines someone’s disability magnitude, as well as their family’s and the society’s disability magnitude. This article will examine some issues object of debate among those who intent to build relationships between public policies, national and international development strategies and human rights international law. Besides, it will analyze some points of view about the pertinence of a human rights focus in Colombia social, cultural and political context. The social, economic and cultural context and Colombian international commitments press on to make an effort to connect local and national policies, global tendencies of development and compliance with human rights and humanitarian law in order to achieve a more comprehensive vision. It will allow society to confront and solve disability problems in a better way. The Disability Intervention National Program has its grounds in the following conceptual elements: Risk Social Management (RSM), which refers to the economic theory that supports a social protection focus. This last focus is the creation base of the Social Protection Office. In the field of disability, the discussion’s main question is whether policies should be build from a RMS focus or from a civilian participation focus, which is more compatible with the approach previous the Conpes document.
