Justicia y paz: la construcción de una visión normalizada e institucionalizada del conflicto armado paramilitar

Resumen
En este trabajo se realizó una investigación socio jurídica del discurso de las veintiséis sentencias proferidas contra paramilitares entre el 2010 y el 2014, con el fin de brindar un acercamiento al fenómeno paramilitar y una comprensión sobre las reparaciones a partir de los discursos de los agentes que se enmarcan en estas. Se buscó comprender el juego de posiciones y juegos implícitos en el espacio judicial, en donde los agentes ejercen una disputa por el establecimiento de un discurso normalizado sobre los hechos producto del conflicto armado. Para ello, se analizarán las concepciones y posturas de las víctimas, victimarios y ente jurídico (juez), con el fin de comprender los discursos que confluyen en el entendimiento del conflicto armado en Colombia y dando cuenta de las formas en que los jueces legitiman y normalizan discursos, identificando jerarquías y desigualdades dadas en la construcción de las sentencias de justicia y paz; esto se realizará teniendo en cuenta el abordaje metodológico y teórico de Van Dijk y los presupuestos conceptuales de Bourdieu en torno al campo jurídico. En primera instancia, se hace una presentación del contexto armado paramilitar según lo presentado en la sentencia; a continuación, se realiza una aproximación de la producción de sentencias; posteriormente, se desarrolla una interpretación sobre las percepciones de los agentes frente a los delitos causados y las afectaciones generadas en el contexto social tras el accionar paramilitar; y por último, se presentan los discursos y disputas frente a las peticiones y exhortaciones en materia de reparación.
Abstract
In this paper, I realized a socio-legal investigation of twenty-six sentences conducted on the twenty-six sentences handed down against paramilitaries between 2010 and 2014, in order to provide an approach to the paramilitary phenomenon and an understanding of reparations based on the speeches of the agents who are framed in these. It sought to understand the set of positions and games implicit in the judicial space, where the agents exert a dispute for the establishment of a normalized discourse on the facts produced by the armed conflict. To this end, the conceptions and positions of the victims, perpetrators and juridical entity (judge) will be analyzed, in order to understand the discourses that converge in the understanding of the armed conflict in Colombia and giving account of the ways in which the judges legitimize and Normalize discourses, identifying hierarchies and inequalities given in the construction of the sentences of justice and peace; This will be done taking into account the methodological and theoretical approach of Van Dijk and the conceptual presuppositions of Bourdieu around the legal field. In the first instance, a presentation is made of the paramilitary armed context as presented in the sentence; Next, an approximation of the production of sentences is made; Later, an interpretation is developed on the perceptions of the agents against the crimes caused and the affectations generated in the social context after the paramilitary action; And finally, the speeches and disputes are presented about the petitions and exhortations in the matter of reparation.
