Resumen

La tutela cautelar judicial constituye una manifestación del derecho de acceso a la justicia y en ese orden de ideas hace parte de uno de los derechos fundamentales de las personas. En tal virtud, la determinación de su alcance corresponde al máximo juez de esa jurisdicción, que en el caso colombiano es la Corte Constitucional, y por ello se propone en el presente artículo identificar los planteamientos efectuados desde la jurisprudencia constitucional sobre la tutela cautelar judicial a la luz de las categorías analíticas que de la misma han ocupado la atención de la doctrina, y a partir de aquellos, formular algunas reflexiones críticas sobre lo que podría hacerse para incrementar el papel que la tutela cautelar judicial debe jugar en función de la eficacia del derecho de acceso a la justicia.

Abstract

The judicial preventive tutelage constitutes a manifestation from the access right to the justice and in that order of ideas it makes part of one of the fundamental rights of people. In such a virtue, the determination of its reach corresponds the maximum judge of that jurisdiction that is the Constitutional Court, and in and of itself this article presently to identify the actual positions from the constitutional jurisprudence on the judicial preventive tutelage by the light of the analytic categories that have occupied the attention of the doctrine of the same one, and starting from those, to formulate some critical reflections on what could be made to increase the paper that the tutelage preventive judicial debit side toplay in function of the effectiveness from the access right to the justice.
