Surrogate Motherhood in Colombia: Towards a Comprehensive and Inclusive Legal Framework

"La maternidad subrogada es un tema que se está presentando en Colombia y que necesita regulación expresa. El único referente jurídico sobre la práctica de la maternidad subrogada en Colombia es la Sentencia T-968 de 2009 de la Corte Constitucional. En esta sentencia la Corte definió este procedimiento como: ""El acto reproductor que genera el nacimiento de un niño gestado por una mujer sujeta a un pacto o compromiso mediante el cual debe ceder todos los derechos sobre el recién nacido a favor de otra mujer que figurará como madre de éste"". En Colombia, a pesar de la ventaja legislativa que tienen otros países del contexto latinoamericano, se presenta un rezago y apenas se está dando el trámite de un proyecto de ley, el cual inició como un intento de migrar al país hacia el marco de la prohibición absoluta pero que en la actualidad se está discutiendo implementar bajo la posibilidad del régimen de permisión regulada. El objetivo principal de este trabajo radica en proponer un marco de legislación sobre el tema de maternidad subrogada para Colombia."
Abstract
"This article proposes legislation surrogate motherhood in Colombia taking into account: 1. The scientific background of assisted human reproduction techniques; 2. The different legal responses from comparative law and international tribunals; 3. The relationship between surrogate motherhood and the filiation concept and its different variables, and 4. The Criminal Law and the jurisprudence of the Colombian high courts answer to it with thematic relevance. In Colombia, the only legal referents on this practice are the progress towards a bill under the possibility of the regime of regulated permission and Sentence T-968 of 2009 of the Constitutional Court, which defined surrogacy as ""The reproductive act that generates the birth of a child gestated by a woman subject to a pact or commitment by which she must assign all the rights over the newborn in favor of another woman who will appear as her mother""."
