Resumen
Este trabajo nació con la finalidad de analizar, verificar y determinar qué incidencias pueden tener y cómo afectan los cupos indicativos o recursos de inversión regional a los principios de contratación pública y presupuestales, cuando son incluidos y utilizados dentro del Presupuesto General de la Nación y los Planes Nacionales de Desarrollo. El proceso investigativo, consiste en hacer un recorrido por el origen de los cupos indicativos desde los llamados auxilios parlamentarios hasta su evolución cómo están consagrados hoy en día. Se hace un acercamiento a la normatividad y conceptos básicos del derecho presupuestal Colombiano para mostrar cómo se incluyen estas partidas presupuestales y si se cumple lo dispuesto en la norma. Se analiza uno a uno los principios de contratación y presupuestales que más pueden verse involucrados en la utilización de estos rubros y se establece si se ven afectados o no.
Abstract
This work was created with the purpose of analyzing, verifying and determining what incidences can have and how the indicative quotas or regional investment resources affect the public contract and budgetary principles, when they are included and used within the General Budget of the Nation and the National Development Plans. The investigative process consists of taking a view of the origin of the indicative quotas from the so-called parliamentary aid to their evolution, how they are consecrated today. An approach is made to the regulations and basic concepts of Colombian budgetary law to show how these budget items are included and if the provisions of the standard are met. The public contract and budgeting principles that can be most involved in the use of these items are analyzed one by one and established whether they are affected or not.
