Resumen
La jurisdicción ordinaria y la jurisdicción especial indígena reconocen sistemas de valores que tienen que ver con otras visiones culturales. Apesar de su importancia en la solución de conflictos, los diversos costos y beneficios entre ambos sistemas conlleva disyuntivas o incompatibilidades. Este artículo pretende contribuir a la reflexión sobre estos problemas de reconocimiento y distribución de la justicia ambiental, preguntándose cuáles son los principios que facilitan los diálogos entre los diferentes sistemas de justicia. Este capítulo está estructurado en tres partes. La primera describe el marco actual de la jurisdicción indígena y sus ampliaciones en el derecho internacional. La segunda presenta un análisis crítico de los alcances del acceso a la justicia ambiental de parte de los pueblos indígenas. La tercera parte concluye argumentando por qué un reconocimiento de la jurisdicción indígena de Colombia parte del reconocimiento en el marco del pluralismo jurídico, la diversidad étnica y cultural, además de una distribución de costos y beneficios.
Abstract
The ordinary justice and indigenous special jurisdiction recognize value systems that have to do with other cultural visions. Despite their importance the case of conflict resolution, the various costs and benefits between both systems entail dilemmas or incompatibilities. This article aims to contribute to the reflection on these problems of acknowledgment and distribution of the environmental justice, wondering about the principles that facilitate dialogues between the different systems of justice. This chapter is structured in three parts. The first describes the current framework of the indigenous jurisdiction and its extensions in law international. The second presents a critical analysis of the scope of the access to environmental justice from indigenous peoples. Third party concludes by arguing why an acknowledgment of jurisdiction Indigenous of Colombia starts with the recognition within the framework of pluralism legal, ethnic and cultural diversity, in addition to a distribution of costs and benefits.
