Resumen
Los criptoactivos son cada vez más nombrados alrededor del mundo, esto a consecuencia del gigantesco desarrollo que han tenido en los últimos años, simultáneamente con los avances tecnológicos que han revolucionado el mundo. Al existir un crecimiento constante de estas figuras, que para muchos aún son demasiado nuevas, se presentan desafíos para el mundo a la hora de controlar su existencia y las repercusiones que estos causan. El presente documento analizara las distintas definiciones y características que se le ha dado a los criptoactivos, establecer las diferencias con las criptomonedas, hacer un recuento de las regulaciones que se le ha dado en otras jurisdicciones y cuál es la postura actual de Colombia, este estudio será en aras de determinar los posibles desafíos que representa el uso de este nuevo tipo de activos en el sistema financiero y legal colombiano.
Abstract
Crypto assets are becoming more and more popular around the world, as a consequence of the gigantic development they have undergone in recent years, hand in hand with the technological advances that have revolutionized the world. The constant growth of these legal institutions, which for many are still too new, presents challenges for the world regarding controlling their existence and the repercussions they cause. This document will analyze the different definitions and characteristics that have been given to crypto assets, establish the differences with cryptocurrencies, make an account of the regulations that have been given in other jurisdictions and what is the current position of Colombia, this study will be in order to determine the possible challenges posed by the use of this new type of assets in the Colombian financial and legal system.
