Resumen
Teniendo en cuenta los eventos del 2020, se estudiarán acontecimientos que afectaron la realidad laboral en Colombia, atendiendo a eventos como despidos masivos y terminaciones unilaterales de contratos laborales para poder realizar un estudio que responda a las realidades sociales, y que con base en esto se puedan señalar las falencias que tiene la normativa actual para proteger efectivamente los derechos de los trabajadores. Esta investigación, tiene una naturaleza teórico-descriptiva en la que con base a normas, jurisprudencia y un caso de estudio, pretende responder a la pregunta de si la facultad unilateral para la terminación de contrato laboral sin justa causa, resulta desproporcionada teniendo en cuenta el propósito que le dió la jurisprudencia a esta figura. According to the events that happened during the 2020, it was possible to see the actual situation of the work relations between employees and the companies. Since the pandemic, companies started dismissing many work relations due to the economic crisis, which lead us to present the present investigation, looking forward to highlighting the shortcomings of the actual labor law in Colombia. This situation, pushed us to present this document, as a theoretical-descriptive investigation based on the current labor regulations, jurisprudence and a particular case of study, to give a conclusion about how the unilateral power to terminate the labor contract can affect the constitutional rights of workers.
Abstract
According to the events that happened during the 2020, it was possible to see the actual situation of the work relations between employees and the companies. Since the pandemic, companies started dismissing many work relations due to the economic crisis, which lead us to present the present investigation, looking forward to highlighting the shortcomings of the actual labor law in Colombia. This situation, pushed us to present this document, as a theoretical-descriptive investigation based on the current labor regulations, jurisprudence and a particular case of study, to give a conclusion about how the unilateral power to terminate the labor contract can affect the constitutional rights of workers.
