La solidaridad legal como factor de humanización del servicio temporal frente al fuero de maternidad de la trabajadora en misión

Resumen
Ante el supuesto de hecho de la iliquidez de una empresa de servicios temporales, la trabajadora en misión con fuero de maternidad se ve enfrentada a enormes dificultades para lograr el goce efectivo de sus derechos fundamentales, situación que en la práctica la invisibiliza, la deshumaniza, la cosifica y la somete a pasar necesidades ante la mirada irresponsable de la empresa usuaria, la pasividad de la jurisprudencia y la inexistencia de normas específicas que regulen la materia. Ante esta realidad, desde una metodología con enfoque cualitativo de tipo hermenéutico, a partir del análisis interpretativo de normas y jurisprudencia vigentes aplicables en la materia, así como de la práctica jurídica participativa, y entrevistas con gerentes y áreas jurídicas, este capítulo propone comprobar si ante la iliquidez de la EST, alguna de las alternativas laborales actuales permite de forma efectiva la garantía de los derechos fundamentales de la trabajadora en misión con fuero de maternidad. Se ahonda entonces en las normas y la jurisprudencia vigentes, para evidenciar que no existe ninguna alternativa laboral que ofrezca una solución efectiva a la trabajadora en misión con fuero de maternidad ante el supuesto de hecho de la iliquidez de la empresa de servicios temporales. Sin embargo, desde una perspectiva solidaria, se propone una alternativa laboral mediante la cual la empresa usuaria sea protagonista y garante del fuero de maternidad de la trabajadora en misión, tomando como soporte la costumbre contractual la cual evidencia que los contratos comerciales ya vienen estableciendo cláusulas en ese sentido, permitiendo con ello la humanización del servicio temporal frente a este fuero constitucional.
Abstract
In the event of the illiquidity of a temporary services company, the worker on assignment with maternity leave faces enormous difficulties in achieving the effective enjoyment of her fundamental rights, a situation that in practice renders her invisible, dehumanizes her, objectifies her and subjects her to hardship under the irresponsible gaze of the user company, the passivity of the jurisprudence and the lack of specific regulations that regulate the matter. In light of this reality, using a methodology with a qualitative approach of a hermeneutic type, based on the interpretative analysis of current regulations and jurisprudence applicable in the matter, as well as participatory legal practice, and interviews with managers and legal areas, this chapter proposes to verify whether, given the illiquidity of the EST, any of the current labor alternatives effectively allow the guarantee of the fundamental rights of the worker on assignment with maternity leave. The current regulations and jurisprudence are then examined in depth to show that there is no labor alternative that offers an effective solution to the worker on assignment with maternity leave in the event of the illiquidity of the temporary services company. However, from a solidarity perspective, a labor alternative is proposed whereby the user company is the protagonist and guarantor of the maternity leave of the worker on assignment, taking as a support the contractual custom which shows that commercial contracts already establish clauses in this sense, thereby allowing the humanization of temporary service in the face of this constitutional jurisdiction.
