Resumen
En los últimos 20 años, la comunidad de Puente Cucuana, en el sur del Tolima, ha sido testigo de la progresiva desaparición del río Cucuana, su principal fuente de agua. Este afluente, que nace en el páramo de Cumbarcó, ha sufrido diversas formas de explotación y deterioro ambiental, especialmente tras la construcción de la represa Corea en su cuenca media. La falta de un sistema de acueducto óptimo y la dependencia exclusiva del río para acceder a agua potable han vulnerado los derechos fundamentales de la comunidad, entre ellos la salud y el mínimo vital. Este trabajo busca analizar la violación del derecho fundamental al agua en Colombia a partir del caso del río Cucuana, evaluando cómo las intervenciones humanas han afectado tanto al caudal como a la vida de los habitantes de Puente Cucuana. Asimismo, se propone identificar los actores responsables del deterioro, comparar las condiciones de la población antes y después de la construcción de la represa y señalar vacíos en la normativa actual para la protección de los ríos en el país.
Abstract
Over the past 20 years, the community of Puente Cucuana, located in southern Tolima, has witnessed the progressive disappearance of the Cucuana River, its main source of water. This river, which originates in the Cumbarcó páramo, has suffered from various forms of exploitation and environmental degradation, particularly after the construction of the Corea dam in its middle basin. The lack of an adequate aqueduct system and the community’s exclusive dependence on the river for drinking water have undermined their fundamental rights, including health and basic livelihood. This study aims to analyze the violation of the fundamental right to water in Colombia through the case of the Cucuana River, assessing how human interventions have affected both its flow and the lives of the inhabitants of Puente Cucuana. It also seeks to identify the actors responsible for its deterioration, compare the living conditions of the population before and after the dam’s construction, and highlight gaps in the current regulations for the protection of rivers in the country.
