Resumen
La investigación doctoral en la PARTE I aborda lo pertinente a la INTELIGENCIA ARTIFICIAL & LA ADMINISTRACIÓN DE JUSTICIA. De manera concreta da a conocer la inteligencia artificial desde la perspectiva técnica y jurídica. Luego, hace alusión a la manera como esta tecnología está transformado y modernizado la Administración de Justicia, y con ocasión de ello, muestra la diversidad de usos y beneficios que tiene esta herramienta en el sector legal. Asimismo, da cuenta de la necesidad de incorporar los principios y los estándares éticos, técnicos y normativos que deben regir el ciclo de vida de la inteligencia artificial en la Administración de Justicia. Y, finalmente analiza la posibilidad de crear un organización global que regule la inteligencia artificial. En la PARTE II, relativa a la JUSTICIA ALGORÍTMICA & RESPONSABILIDAD ESTATAL, la investigación hace referencia a la evolución histórica que dio origen a la responsabilidad estatal desde la perspectiva del derecho comparado. Luego y en función de los elementos de la responsabilidad, la autora identifica los riesgos que se generan para los derechos humanos cuando se hace uso de la inteligencia artificial en la Administración de Justicia. Posteriormente, hace uso de la prospectiva jurídica para señalar que cuando estos riesgos se materializan, se configura un daño antijurídico que es imputable al Estado – Juez como primer respondiente. Hecho esto, se procede a analizar el segundo elemento de la responsabilidad que es la imputación. A efecto de lo anterior, se hace uso de un test para analizar el régimen de responsabilidad aplicable en función de la autonomía de la inteligencia artificial y los actores intervinientes. Luego, analiza el daño – perjuicio y las diversas modalidades de reparación encaminadas a garantizar una reparación integral de los daños. Finalmente hace alusión a los mecanismos procesales para reparar.
Abstract
The doctoral research in PART I addresses issues related to ARTIFICIAL INTELLIGENCE & THE ADMINISTRATION OF JUSTICE. Specifically, it presents artificial intelligence from a technical and legal perspective. It then refers to how this technology is transforming and modernising the administration of justice, and in doing so, it shows the diversity of uses and benefits of this tool in the legal sector. It also highlights the need to incorporate the ethical, technical and regulatory principles and standards that should govern the life cycle of artificial intelligence in the administration of justice. Finally, it analyses the possibility of creating a global organisation to regulate artificial intelligence. In PART II, on ALGORITHMIC JUSTICE & STATE RESPONSIBILITY, the research refers to the historical evolution that gave rise to state responsibility from a comparative law perspective. Then, based on the elements of responsibility, the author identifies the risks to human rights when artificial intelligence is used in the administration of justice. Subsequently, she uses legal foresight to point out that when these risks materialise, they constitute unlawful damage that is attributable to the state – the judge as the first responder. Having done so, she proceeds to analyse the second element of liability, which is attribution. To this end, a test is used to analyse the applicable liability regime based on the autonomy of artificial intelligence and the actors involved. She then analyses the damage and the various forms of redress aimed at ensuring full compensation for the damage. Finally, she refers to the procedural mechanisms for redress.
