Sentencias de delimitación de la Corte Internacional de Justicia en las constituciones nacionales de América Latina : recepción o resistencia

The doctoral thesis studies the bindingness, enforceability, effectiveness and resistance to the judgments International Court of Justice and its relationship (or collision) with domestic law. In particular, the constitutional territorial clauses in Latin America, with attention to the cases of Colombia, Nicaragua, Salvador and Honduras, and the Nicaragua litigation against Colombia and Peru against Chile. First, the thesis analyzes the rules that proclaim the supremacy of international law in matters of international judgments, as well as the deficiencies of the international system in recognizing the role of domestic law in the enforceability of international law. Likewise, it addresses the recognition or not of international law by constitutional law. It also evaluates the lack of developments in terms of mechanisms to incorporate international judgments into national law in the area of territorial sovereignty, and territorial and maritime delimitation, an urgent matter considering the increase in territorial litigation between Latin American nations. The thesis discusses the myth of the generalized breach of the judgments of the ICJ, to verify its constant compliance even in spite of strong local opposition. Subsequently, through the concepts of enforceability, effectiveness and resistance and backlash to the judgments of the ICJ, the thesis studies the obstacles presented by domestic law in Latin America for the full effectiveness of this type of international judicial decisions; For this goal, the category of constitutionalized forms or mechanisms of opposition to international judgments in the area of territory is proposed.

The Expulsion of Resident Colombian Nationals during the Colombia-Venezuela Border Dispute: An “Under the Radar” Case for Diplomatic Protection of Human Rights?

While International Humanitarian, Refugee and Human Rights Law are frequently resorted to in the search for remedies for human rights violations, the Public International Law remedy of Diplomatic Protection is often forgotten, perhaps because there are few cases fitting the legal requirements for that remedy. The Venezuelan expulsions and property confiscations in 2015 and 2017 of Colombian residents without due process and, frequently, with violence may provide a useful example of an appropriate case for Diplomatic Protection arising within the context of a forced expulsion of an identifiable nationality. The following article, result of a research project regarding international law enforceability, reviews the current law on Diplomatic Protection and, within the context of a factual survey of the treatment of Colombian nationals by Venezuela, undertakes an analysis as to whether the facts of the case in fact give rise to a remedy of Diplomatic Protection. Effectively, the article argues in favour of the availability of this remedy as an option for the Colombian government

This chapter gives an overview of the regime of State responsibility for international wrongful acts. Responsibility in international law is the corollary of any international obligation and the necessary consequence of its breach. The chapter explores the notion of an internationally wrongful act, the elements needed to attribute it to a State through the acts or omission of its agents, the circumstances precluding wrongfulness, and the consequences of responsibility, including reparations.

The reports presented here are the result of the IV Workshop Jean Monnet Network - BRIDGE on "Dialogues on economic and sustainable development between the EU and third countries" that took place on October 4, 2022, in a hybrid mode, at the Faculty of Law of Universidad del Rosario, Colombia, and which had the support of the Colombian Academy of International Law This initiative sparked an intense debate among professors and researchers from different universities on the theoretical and practical aspects of sustainable development in trade relations between countries Latin American and European countries, and important reflections on the challenges to meet some of the Sustainable Development Goals of the United Nations 2030 Agenda and specific cuts on the environmental and commercial situation in some countries or regions.The Memories of the IV Workshop are framed within the activities carried out by the Jean Monnet Network "Building Rights and Development Knowledge between European Union and Latin America - BRIDGE", a project financed by the Erasmus + Program of the European Union (620744-EPP-1-2020-1-BR- EPPJMO-NETWORK) and whose objective is to promote study and research on European integration in Latin America and build bridges of dialogue and exchange of good practices between regions. This project is led by the Federal University of Santa Catarina (Brazil) and the following associated institutions: National Autonomous University of Mexico (Mexico), University of Lisbon (Portugal), University of Seville (Spain), University of Milan (Italy), University of Buenos Aires (Argentina) and the University of Rosario (Colombia).
