dc.descriptionEste artículo es parte del trabajo de investigación de la Clínica de Derecho Internacional, organizado por la Universidad del Rosario, Bogotá, Colombia y el Instituto Iberoamericano de La Haya para la Paz, los Derechos Humanos y la Justicia Internacional (IIH), en cooperación con la Oficina. de Defensa Pública de Víctimas (OPCV) de la Corte Penal Internacional (CPI). Este memorando busca dar respuesta a las siguientes tres preguntas sobre el caso Dominic Ongwen: A) ¿Cómo el ser un ex niño soldado (o cualquier circunstancia equivalente en la que un niño sea obligado a cometer delitos o sometido a cualquier tipo de victimización), afecta la gravedad de ¿el crimen? B) ¿Debe la Corte considerar este hecho como parte de la evaluación de la gravedad de los delitos o debe ser considerado como parte de los criterios para determinar la existencia de circunstancias agravantes o atenuantes (siempre que dicho factor pueda ser evaluado una sola vez por un Cámara ya sea como parte de la gravedad o circunstancia agravante, no acumulativa)? C) ¿Qué opción es la más adecuada en el contexto de las disposiciones legales de la CPI?spa
dc.description.abstractThis paper is part of the research work by the International Law Clinic, organized by the Universidad del Rosario, Bogotá, Colombia and the Ibero-American Institute of the Hague for Peace, Human Rights and International Justice (IIH), in cooperation with the Office of Public Counsel for Victims (OPCV) of the International Criminal Court (ICC). This memorandum seeks to answer the following three questions regarding the Dominic Ongwen case: A) How does being a former child soldier (or any equivalent circumstances where a child is forced to commit crimes or subjected to any type of victimisation), affect the gravity of the crime? B) Should the Court consider this fact as part of the assessment of the gravity of the crimes or should they be considered as part of the criteria to determine the existence of aggravating or mitigating circumstances (provided that such factor can be assessed only once by a Chamber either as part of gravity or aggravating circumstance, not cumulatively)? C) Which option is best suited in the context of the statutory provisions of the ICC?eng
