¿Harta dónde puede llegar el juez? El alcance del poder judicial cuando se enfrenta al ejecutivo

dc.descriptionLa presente monografía explora los límites de los tribunales constitucionales cuando deciden sobre problemas estructurales, entendidos como aquellas problemáticas generalizadas de una sociedad que carecen de una solución institucional clara. A partir de una revisión crítica de la literatura sobre el experimentalismo democrático y las sentencias estructurales, se construye un espectro de intervención judicial sobre el ejecutivo, capaz de dar cuenta tanto de las decisiones en las que las cortes asumen una postura deferente como de aquellas en las que intervienen directamente en la política pública. Sobre ese espectro se desarrolla un estudio comparado de tres casos: la deferencia Chevron, que operó en los Estados Unidos entre 1984 y 2024, como exponente de la deferencia; el continuing mandamus de la Corte Suprema de la India en el caso PUCL v. Union of India, encaminado a proteger el derecho a la alimentación (2001–2017); y el estado de cosas inconstitucional carcelario colombiano (1998–2022), como exponentes de sentencias estructurales con mecanismos de intervención sofisticados. De la comparación surgieron tres hallazgos: primero, las cortes, aun en sus actuaciones deferentes, deciden con el propósito de romper los bloqueos institucionales formados por el ejecutivo y el legislativo; segundo, las cortes modulan constantemente sus niveles de intervención en función de factores internos (autorregulación) y externos (heterorregulación); y tercero, aunque influyen fuertemente en la actuación del ejecutivo, no se convierten en jueces administrativos, no examinan la idoneidad de las políticas públicas sino su funcionalidad para cumplir los objetivos constitucionales. Se concluye reivindicando la ley como el mecanismo claro y deliberado para limitar la actuación judicial, incluso en su tarea desestabilizadora, ya que los jueces terminan viéndose obligados a sujetarse a ella.
dc.description.abstractThis monograph explores the limits of constitutional courts when they decide on structural problems, understood as those widespread societal issues that lack a clear institutional solution. Drawing on a critical review of the literature on democratic experimentalism and structural judgments, it builds a spectrum of judicial intervention over the executive branch, capable of accounting both for decisions in which courts adopt a deferential stance and for those in which they intervene directly in public policy. Along that spectrum, a comparative study of three cases is developed: the Chevron deference, which operated in the United States between 1984 and 2024, as an exponent of deference; the continuing mandamus of the Supreme Court of India in the case of PUCL v. Union of India, aimed at protecting the right to food (2001–2017); and the Colombian prison-related unconstitutional state of affairs (1998–2022), as exponents of structural judgments with sophisticated mechanisms of intervention. From this comparison, three findings emerged: first, that courts, even in their deferential actions, decide with the purpose of breaking the institutional deadlocks formed by the executive and the legislative branches; second, that courts constantly modulate their levels of intervention according to internal factors (self-regulation) and external ones (hetero-regulation); and third, that although they strongly influence the executive's actions, they do not become administrative judges, they do not examine the suitability of public policies but rather their functionality in fulfilling constitutional objectives. The monograph concludes by vindicating the law as the clear and deliberate mechanism for limiting judicial action, even in its destabilizing task, since judges ultimately find themselves compelled to abide by it.
