Resumen
Esta tesis doctoral estudia el fenómeno de la trata de personas en Colombia desde un enfoque del Derecho Internacional de los Derechos Humanos, haciendo un especial énfasis en su relación con el uso de las nuevas tecnologías tanto para la captación de víctimas, como para la lucha de este fenómeno por parte de los Estados y la sociedad. Se realiza un examen global sobre los alcances de la TP como un delito feminizado, lo que implica y su relación con el uso de las tecnologías, desde una perspectiva general que permite se estudie cómo el fenómeno ha estado presente y cómo tiene algunos matices en los que se manifiesta actualmente. Por tanto, estudia algunos de los elementos estructurales que la componen, y de manera subsiguiente, los factores que impulsan o favorecen la permanencia y expansión de la TP. Además, se muestra que la perspectiva de género es necesaria y debe incluirse de manera transversal y en conjunto con el uso de las nuevas tecnologías, pues son aspectos básicos para el análisis y elaboración de estrategias para el cambio social a través de las legislaciones y políticas públicas. También analiza algunos de los efectos de la Globalización, y la repercusión en la vulneración de derechos de muchas víctimas, siendo las principales víctimas las mujeres y niñas. En función de ello, se tornó relevante dimensionar la verdadera importancia que tienen los DDHH de las víctimas, y la necesaria protección por parte de los Estados ante la lucha y erradicación del fenómeno en pro de salvaguardar sus DDHH y como respuesta frente a la responsabilidad de sentar las bases de un nuevo “orden global”, más humano y solidario.
Abstract
This doctoral thesis studies the phenomenon of human trafficking in Colombia from an approach of International Human Rights Law, with special emphasis on its relationship with the use of new technologies both for the recruitment of victims and for the fight against this phenomenon by States and society. A global examination is made on the scope of PT as a feminized crime, what it implies and its relationship with the use of technologies, from a general perspective that allows studying how the phenomenon has been present and how it has some nuances in which it is currently manifested. Therefore, it studies some of the structural elements that compose it, and subsequently, the factors that drive or favor the permanence and expansion of PT. It also shows that the gender perspective is necessary and should be included in a cross-cutting manner and in conjunction with the use of new technologies, as these are basic aspects for the analysis and development of strategies for social change through legislation and public policies. It also analyzes some of the effects of globalization and its repercussions on the violation of the rights of many victims, the main victims being women and girls. In view of this, it became relevant to dimension the true importance of the human rights of the victims, and the necessary protection by the States in the fight and eradication of the phenomenon in order to safeguard their human rights and as a response to the responsibility of laying the foundations of a new “global order”, more humane and supportive.
