dc.descriptionEl presente trabajo analiza si existe, o no, alguna diferencia conceptual entre las expresiones daño “intergeneracional” y “transgeneracional”. Con este fin, se examina, en primer lugar, el tratamiento de ambos términos realizado por la doctrina psicológica, para a continuación estudiar lo señalado hasta el momento por la doctrina de Derecho Internacional Penal (DIP) y Derecho Internacional de los Derechos Humanos (DIDH) y por los pronunciamientos de: (a) la Corte Penal Internacional (CPI); (b) los Tribunales Penales Internacionales para la ex Yugoslavia (TPIY) y Ruanda (TPIR); (c) los tribunales híbridos; (d) los organismos del sistema de protección universal de derechos humanos; y, (e) los tribunales de los sistemas regionales de protección de los derechos humanos.es
dc.description.abstractThis work seeks to analyze whether there is any difference between “intergenerational” and “transgenerational” harm. Accordingly, the first section will study both terms from a psychological viewpoint. The second section will revolve around International Criminal Law (ICL) and International Human Rights Law (IHRL) research, complemented by the decisions of: (a) the International Criminal Court (ICC); (b) the International Criminal Tribunal for the former Yugoslavia (ICTY) and Rwanda (ICTR); (c) the Hybrid Criminal Courts; (d) the universal human rights’ system committees; and, (e) regional tribunals for the protection of human rights.es
