Resumen
El presente trabajo de investigación tiene como finalidad narrar, desde un enfoque de Derechos Humanos, el concepto de Trata de Personas con fines de explotación sexual en mujeres. Para los mencionados fines, serán estudiados casos específicos en filmes cinematográficos seleccionados. Entendiendo el poder de movilización de la narrativa audiovisual, se caracterizará el delito de Trata de Personas como una grave violación a los Derechos Humanos, a través de una mirada crítica y desde la perspectiva del cine como instrumento social de sensibilización y denuncia de esta conducta. En tal sentido, se presentarán los elementos conceptuales relacionados con la Trata de Personas desde un enfoque de Derechos Humanos, relacionándolos con los filmes seleccionados. Seguidamente, se señalarán las violaciones de Derechos Humanos en la trata de personas en la modalidad de explotación sexual de mujeres. Además, se identificarán las responsabilidades internacionales de los Estados y las medidas de reparación a las víctimas de violaciones de derechos con ocasión de la trata de mujeres en el contexto del derecho internacional de los derechos humanos. Como resultado de esta investigación, también será posible establecer, si el Cine ha abordado la trata de personas de manera coherente con la realidad actual, y si tal abordaje ha sido suficiente, o en términos generales “se ha quedado corto” y falta mucho camino por recorrer.
Abstract
The purpose of this research work is to narrate, from a human rights approach, the concept of trafficking in persons for the purpose of sexual exploitation of women. For the above mentioned purposes, specific cases will be studied in selected cinematographic films. Understanding the mobilizing power of the audiovisual narrative, the crime of Human Trafficking will be characterized as a serious violation of Human Rights, through a critical view and from the perspective of cinema as a social instrument of sensitization and denunciation of this conduct. In this sense, the conceptual elements related to Human Trafficking from a Human Rights approach will be presented, relating them to the selected films. Next, human rights violations in human trafficking in the form of sexual exploitation of women will be pointed out. In addition, the international responsibilities of the States and the measures of reparation to the victims of rights violations due to trafficking in women in the context of international human rights law will be identified. As a result of this research, it will also be possible to establish whether the Cinema has addressed human trafficking in a manner consistent with the current reality, and whether this approach has been sufficient, or in general terms "has fallen short" and there is still a long way to go.
