dc.descriptionEste artículo es parte del trabajo de investigación de la Clínica de Derecho Internacional, organizado por la Universidad del Rosario, Bogotá, Colombia y el Instituto Iberoamericano de La Haya para la Paz, los Derechos Humanos y la Justicia Internacional (IIH), en cooperación con la Oficina. de Defensa Pública de Víctimas (OPCV) de la Corte Penal Internacional (CPI). Este memorando busca responder las siguientes dos preguntas: 1. ¿En qué jurisdicciones nacionales, y bajo qué circunstancias y criterios, se puede responsabilizar penalmente a los niños soldados menores de 15 años por los delitos cometidos durante el período de su reclutamiento? ¿Qué tipo de castigo se prevén? 2. En las jurisdicciones nacionales y en los casos que involucran a ex niños soldados (o cualquier circunstancia equivalente en la que los niños fueron obligados a cometer delitos o sometidos a cualquier tipo de victimización), ¿qué papel desempeñan estos elementos en su sentencia cuando son condenados por delitos cometidos? ¿como adultos?spa
dc.description.abstractThis paper is part of the research work by the International Law Clinic, organized by the Universidad del Rosario, Bogotá, Colombia and the Ibero-American Institute of the Hague for Peace, Human Rights and International Justice (IIH), in cooperation with the Office of Public Counsel for Victims (OPCV) of the International Criminal Court (ICC). This memorandum seeks to answer the following two questions: 1. In which national jurisdictions, and under which circumstances and criteria, can child soldiers under 15 be held criminally liable for crimes committed during the period of their recruitment? What kinds of punishment are foreseen? 2. In national jurisdictions and in cases involving former child soldiers (or any equivalent circumstances where children were forced to commit crimes or subjected to any type of victimization), what role (s) do these elements play in their sentencing when convicted of crimes committed as adults?eng
