Resumen
La concepción de los ataques bioterroristas ha evolucionado a lo largo de la historia debido al surgimiento de nuevos avances científicos y tecnológicos. Por ello, los Estados deben analizar la eficacia de emplear el “derecho a la legítima defensa” para contrarrestar este tipo de ataques perpetrados por otros actores a nivel internacional, con el fin de salvaguardar y proteger la paz y la seguridad de las naciones. En este contexto, el objetivo de este artículo es analizar la repercusión de la naturaleza de los ataques bioterroristas, considerados una nueva amenaza para la paz y la seguridad de un Estado, en el concepto del derecho a la legítima defensa, tal como está establecido en el artículo 51 de la Carta de las Naciones Unidas. Para ello, se emplea un enfoque cualitativo-cifrable y cualitativo-interpretativo, basado en un análisis de contenido. Lo anterior busca comprender los efectos irremediables y nocivos de los ataques bioterroristas, así como la necesidad de redefinir el derecho a la legítima defensa y establecer lineamientos específicos para su aplicación en el marco del surgimiento de esta amenaza, dado el dinamismo del derecho internacional a lo largo del tiempo.
Abstract
The concept of bioterrorist attacks has evolved throughout history due to the emergence of new scientific and technological advances. Therefore, States must analyze the effectiveness of using the “right to self-defense” to counteract this type of attacks perpetrated by other actors at the international level, in order to save and protect the peace and security of nations. In this context, the objective of this article is to analyze the impact of the nature of bioterrorist attacks, considered a new threat to the peace and security of a State, on the concept of the right to self-defense, as established in Article 51 of the Charter of the United Nations. To do so, a qualitative-codified and qualitative-interpretative approach is used, based on a content analysis. The above seeks to understand the irremediable and harmful effects of bioterrorist attacks, as well as the need to redefine the right to self-defense and establish specific guidelines for its application in the context of the emergence of this threat, given the dynamism of international law over time.
