dc.descriptionEl presente trabajo analiza si se puede calificar el matrimonio forzado como un CLH de esclavitud sexual o de otros actos inhumanos. Así mismo se estudia si es posible aplicar, bajo ciertas circunstancias, la figura de las cumulative convictions, para condenar simultáneamente por ambos delitos, debido a que el matrimonio forzado excede el contenido del tipo penal del CLH de esclavitud sexual porque no todas las afectaciones sufridas por las víctimas son de naturaleza sexual. Para poder analizar esta figura, en el presente trabajo se realizará un estudio jurisprudencial y doctrinal prestando particular atención a los tribunales penales internacionales e híbridos que han conocido de situaciones en las que se ha presentado la práctica del matrimonio forzado.es
dc.description.abstractThis paper seeks to analyze whether forced marriage should be legally characterized as a CAH of “sexual slavery” or as a CAH of “other inhumane acts”. Furthermore, it studies the possibility, under specific circumstances, of convicting an accused person with cumulative convictions for both CAH. This possibility is explored because forced marriage is not entirely encompassed by the legal definition of sexual slavery, since not all types of harm experienced by victims of forced marriage are sexual in nature. In order to analyze and study this issue, a jurisprudential and doctrinal study will be conducted, particularly focusing on case law of international and hybrid criminal courts.es
