dc.descriptionEl trabajo plantea la existencia de límites al poder constituyente en momentos de ruptura constitucional derivados del desarrollo actual del derecho internacional, según el cual los Estados constitucionales contemporáneos se afilian a postulados básicos de la Carta de las Naciones Unidas, la Declaración Universal de Derechos Humanos y las normas imperativas de ius cogens. Esos límites se traducen en la norma inderogable de establecer un régimen respetuoso de los derechos humanos, oponibles incluso al constituyente primario. Además, se abordan los retos para la exigibilidad de la norma que establece la obligación de mantener un régimen respetuoso de los derechos humanos, a partir del monismo, del dualismo y de la reticularidad. En la parte final se proponen algunas posibilidades de exigibilidad. spa
dc.description.abstractThis paper argues the existence of limits to the Constituent Power in moments of constitutional break. This is derived from the current development of international law according to which constitutional contemporary States agree upon the basic rules of the Charter of the United Nations, the Universal Declaration of Human Rights and the mandatory ius cogens rules. Those limits are obligatory, even to the constituent power. This paper deals with the challenges for the enforceability of the rule that establishes the obligations of preserving a regime that respects human rights, taking into account the theories about monism, dualism, and reticularidad. In the last part, the research proposes some enforceability alternatives.eng
