| dc.description | La trilogía sobre el papel de la Corte Penal Internacional (CPI) desde perspectivas no positivistas, elaborada para conmemorar el XV aniversario del Instituto Iberoamericano de La Haya, ofrece una visión interdisciplinaria renovada sobre esta institución. Bajo la dirección académica de Héctor Olasolo, Mario-Iván Urueña-Sánchez y R.J. MacLean, el proyecto busca integrar enfoques filosóficos y teológicos con perspectivas del derecho internacional y las relaciones internacionales. El texto subraya que el estudio de la CPI ha estado dominado por el positivismo jurídico, lo cual resulta insuficiente para comprender plenamente las condiciones históricas, políticas y sociales que permitieron su creación y consolidación. En consecuencia, se propone un diálogo más amplio con otras disciplinas para entender mejor el funcionamiento de la Corte, especialmente en el contexto de atrocidades masivas. | dc.description.abstract | The trilogy on the role of the International Criminal Court (ICC) from non-positivist perspectives, prepared for the 15th anniversary of the Ibero-American Institute of The Hague, presents a renewed interdisciplinary understanding of the ICC. Directed by Héctor Olasolo, Mario-Iván Urueña-Sánchez, and R.J. MacLean, the work brings together philosophical and theological approaches with perspectives from international law and international relations. The foreword notes that scholarship on the ICC has largely relied on legal positivism, which limits a full comprehension of the historical, political, and social conditions that enabled the Court’s establishment and consolidation. Therefore, the text calls for broader dialogue with other disciplines to better interpret the ICC’s functioning, particularly concerning mass atrocities. The trilogy is structured around two overarching analytical axes—critical studies and subaltern historical-contextual approaches—applied across all four contributing disciplines, providing a deeper and more nuanced understanding of the ICC’s role as the only permanent international criminal court. | |
