Resumen
El sistema de Responsabilidad Objetiva existente en Colombia no es propio del sistema jurídico colombiano, por lo tanto adolece de los mismos problemas de su origen que es el Derecho español, y estos problemas afectan de manera grave los fines de la Responsabilidad Patrimonial de la Administración Pública, haciendo necesario un replanteamiento para subsanar estos inconvenientes y transformando el sistema de Responsabilidad Patrimo-nial de la Administración Pública colombiano en uno a la vanguardia en la región.El enfoque de la presente investigación es de carácter deductivo, porque partirá de fundamentos jurídicos pre-viamente establecidos en sistemas tanto en Francia como en España. También se estudiarán conceptos genera-les de la Responsabilidad Patrimonial de la Administración Pública; para así lograr establecer si la Responsabili-dad Objetiva cumple o no con los fines de la Responsabilidad Patrimonial de la Administración Pública
Abstract
The system of Objective Responsibility existing in Colombia is not typical of the Colombian legal system, there-fore it suffers from the same problems of its origin the Spanish law, and these problems seriously affect the purposes of the Equity responsibility of the Public Administration, which needs a rethinking in order to over-come these inconveniences and transform the Equity responsibility of the Public Administration into one at the forefront of the region.The approach of the present research is of a deductive character, because it will start from juridical foundations previously established in systems in both France and Spain. It will also study general concepts of the Equity responsibility of the Public Administration; in order to establish whether or not the Objective Responsibility complies with the purposes of the Equity responsibility of the Public Administration
