Resumen
La presente investigación pretende identificar los principales cambios promulgados por el Estado y sus instituciones para garantizar la prestación de los servicios de salud a la población migrante no regularizada. Teniendo en cuenta dicha regulación, así como las subreglas emitidas por la Corte Constitucional en fallos en los que los mismos migrantes interpusieron tutelas para proteger su derecho a la salud (así no sean casos de Covid-19), el propósito principal es analizar si el marco normativo y la jurisprudencia ha sido suficiente para proteger el derecho a la salud de esta población al haberse contagiado de Covid-19.
Abstract
His research aims to identify the main changes enacted by the State and its institutions to guarantee the provision of health services to the non-regularized migrant population. Taking into account said regulation, as well as the sub-rules issued by the Constitutional Court in rulings in which the migrants themselves filed guardianships to protect their right to health (even if they are not cases of Covid-19), the main purpose is to analyze whether the regulatory framework and jurisprudence has been sufficient to protect the right to health of this population as they have been infected with Covid-19.
