Resumen
La presente investigación tiene como objetivo analizar cómo una demanda de acción de grupo presentada en el contencioso administrativo puede ser considerada restauradora, con respecto a las lesiones que generan un daño antijurídico. Se hará énfasis en las características y elementos que deben contener una sentencia dictada en dicho medio de control para ser considerada restauradora. Se analizará a la luz de los estudios en justicia restaurativa y principios de justicia restaurativa propuestos por Howard Zehr (2015). Se analizará el contexto social y cultural, así como las propuestas de reparación y la participación de las partes afectadas en el proceso. Se buscará demostrar cómo un enfoque en la reparación integral puede contribuir a lograr una verdadera reparación del daño causado y promover la responsabilidad y la reconciliación entre las partes involucradas.
Abstract
This study will use a case study approach to identify the elements that a class action must contain to achieve restorative results. For this purpose, the case of the Council of State ruling on the Doña Juana landfill spill, which occurred on 27 September 1997, will be used. The objective will be to identify the elements that make a group action aimed at a restorative result in order to identify variants that can be used in other cases with the similar circumstances. The methodology used will be a case study of a judgment that applied the standards of comprehensive reparation, with the aim of identifying elements that can be used in other cases. For this purpose, written sources such as a lawsuit, judgment and proves will be used.
