Resumen
El imparable avance en la tecnología, específicamente en las neurotecnologías, ha marcado un desafío en la forma en la que entendemos el régimen actual de derechos humanos. La ciencia no solo ha sido un elemento transformador de la vida cotidiana, sino que también redefine los límites de la libertad, la privacidad y otros derechos. Es claro que este nuevo escenario de avances vertiginosos impactará de manera directa en los derechos humanos. Pese a lo anterior, no existe consenso sobre la necesidad de legislar en materia de neuroderechos. El presente documento tiene por objeto analizar el régimen actual de derechos humanos (Sistema Interamericano) para identificar su alcance y limitaciones respecto al uso e implementación de neurotecnologías en aspectos cotidianos. De esta manera, se sentará una postura sobre si es necesaria la regulación de estos a través de un tratado internacional o si, por el contrario, basta con fortalecer y adaptar el marco jurídico internacional y nacional vigente.
Abstract
The unstoppable advancements in technology, specifically in neurotechnologies, posed a significant challenge to the way we understand the current Human Rights framework. Science has not only been a transformative element of everyday life, but it is also redefining the boundaries of freedom, privacy, and other rights. It is clear that this new scenario of rapid advances will have a direct impact on Human Rights. Nevertheless, there is no consensus regarding the need to legislate on neurorights. This paper aims to analyze the current Human Rights framework (the Inter-American system) in order to identify its scope and limitations concerning the use and implementation of neurotechnologies in everyday contexts. This will determine whether their regulation through an international treaty is necessary or whether, on the contrary, it is sufficient to strengthen and adapt the current international and national legal framework.
