| dc.description | El artículo comienza con algunas precisiones sobre la noción de guerra civil y sus relaciones con el derecho internacional, desde comienzos del siglo XX. Desarrolla el tema de las normas aplicables a este tipo de conflictos a partir tanto de los protocolos de Ginebra como·de las normas americanas aplicables para el derecho internacional humanitario; incluyendo en el análisis el tema del canje de rehenes. Discute igualmente las consecuencias del reconocimiento de beligerancia, tanto para el Estado como para los rebeldes implicados. Finalmente contiene algunas consideraciones sobre las diferencias entre el reconocimiento de beligerancia y la aplicación del derecho internacional humanitario, con la posible aplicación del tema al caso colombiano. | spa |
| dc.description.abstract | The article begins with a clarification of the notion of civil war and its relationship with lnternational Law throughout the twentieth century. The article develops the subject in light of the applicable norms as stated in the Geneva Protocols, lnter-American and lnternational Humanitarian Law. lt considers the question of hostage exchange, as well as the consequences of acknowledging belligerence for the state and for the rebeis. The article ends with a distinction between belligerence and the applicability of lnternational Humanitarian Law and considers the implications of this distinction for the Colombian case. | eng |
