Más allá del papel y la firma: la última voluntad en tiempos digitales

| dc.description | El presente ensayo analizará la ausencia del reconocimiento jurídico expreso frente al patrimonio digital sucesible en Colombia y aquellos desafíos que se podrán plantear frente a la transmisión mortis causa de activos, bienes y derechos digitales, así como la disposición mediante el testamento digital. Se estudian aquellas disposiciones nacionales vigentes, la experiencia comparada en sistemas extranjeros como Alemania, España y Estados Unidos, junto al papel que pueda desempeñar la tecnología blockchain para poder validar y ejecutar las últimas voluntades en los entornos digitales. Partiendo de la normatividad vigente, entre ellos, la Ley 527 de 1999, el Decreto 2364 de 2012 y la Resolución 011 de 2021 de la Superintendencia de Notariado y Registro, se puede abstraer que en Colombia no se admite un reconocimiento autónomo al testamento digital ni se limita su alcance jurídico, no obstante, permitir actuaciones notariales electrónicas y testamentos otorgados por medios digitales. Por ello, se propone avanzar hacia una regulación moderna la cual pueda incorporar la noción del patrimonio digital sucesible, en donde se incluyan los activos y derechos digitales dentro del caudal hereditario que pueda ser desarrollado con instrumentos tecnológicos como los contratos inteligentes y certificación blockchain, capaces de poder garantizar la autenticidad, integridad e inmutabilidad de la voluntad del causante, así como la ejecución efectiva de aquellas disposiciones post mortem dentro del entorno digital. | |
| dc.description.abstract | This essay will analyze the absence of explicit legal recognition of inheritable digital assets in Colombia and the challenges that may arise regarding the mortis causa transfer of digital assets, goods, and rights, as well as their disposition through a digital will. It examines the current national legal provisions, the comparative experience of foreign legal systems such as Germany, Spain, and the United States, together with the role that blockchain technology may play in validating and executing last wills and testaments within digital environments. Based on the current legal framework, including Law 527 of 1999, Decree 2364 of 2012, and Resolution 011 of 2021 issued by the Superintendence of Notaries and Registry, it can be inferred that Colombia does not recognize the digital will as an autonomous legal institution nor clearly define its legal scope, despite allowing electronic notarial procedures and wills executed through digital means. Therefore, this essay proposes advancing toward a modern legal regulation capable of incorporating the notion of inheritable digital assets, whereby digital assets and rights are included within the estate, supported by technological instruments such as smart contracts and blockchain certification, capable of guaranteeing the authenticity, integrity, and immutability of the testator’s will, as well as the effective execution of post-mortem dispositions within the digital environment. | |
