Resumen
La trilogía sobre el papel de la Corte Penal Internacional (CPI) desde perspectivas no positivistas, elaborada con ocasión del XV aniversario del Instituto Iberoamericano de La Haya para la Paz, los Derechos Humanos y la Justicia Internacional, tiene como objetivo ampliar la comprensión interdisciplinaria del funcionamiento de la CPI. Dirigida académicamente por Héctor Olasolo, Mario-Iván Urueña-Sánchez y R.J. MacLean, esta obra busca conectar enfoques filosóficos y teológicos con los del derecho internacional y las relaciones internacionales. El texto sostiene que la doctrina tradicional se ha centrado en visiones positivistas, lo cual resulta insuficiente para entender plenamente los factores que han permitido la consolidación de la CPI. Por ello, se propone un análisis que incorpore disciplinas que ofrezcan una comprensión más profunda de las atrocidades masivas y del rol del único tribunal penal internacional permanente. La trilogía se estructura alrededor de dos ejes analíticos: los estudios críticos y los enfoques histórico-contextuales subalternos, que atraviesan todas las disciplinas implicadas.
Abstract
The trilogy on the role of the International Criminal Court (ICC) from non-positivist perspectives—prepared for the 15th anniversary of the Ibero-American Institute of The Hague for Peace, Human Rights and International Justice—aims to broaden the interdisciplinary understanding of the ICC. Under the academic direction of Héctor Olasolo, Mario-Iván Urueña-Sánchez, and R.J. MacLean, the work fosters dialogue between philosophical and theological approaches and the fields of international law and international relations. The text argues that traditional doctrine, mostly based on legal positivism, offers an incomplete view of the ICC. A holistic analysis requires going beyond the Statute of the ICC and related international instruments, incorporating additional disciplines that shed light on mass atrocities and the role of the world’s only permanent international criminal court. The trilogy develops two main analytical axes—critical studies and subaltern historical-contextual approaches—applied transversally across all four disciplines involved.
