Resumen
En este texto pretendemos exponer algunas de las ideas centrales de la Teoría de la Justicia del filósofo norteamericano John Rawls. En primer lugar, examinaremos las características generales de los dos principios de la justicia; en segundo lugar, analizaremos cómo dichos principios se desarrollan en un Estado democrático en lo que Rawls denomina la “secuencia de las cuatro etapas”. Expuesto lo anterior nos concentraremos en dos de esas cuatro etapas: por un lado, relacionaremos la segunda de las cuatro etapas con la teoría del poder constituyente, concepto central en el constitucionalismo moderno. Por otro lado, estudiaremos la última etapa de esa secuencia de cara al papel del juez en Colombia, en concreto con relación al control constitucional. Por último, intentaremos mostrar cómo ha sido la recepción del autor norteamericano en la jurisprudencia de la Corte Constitucional colombiana.
Abstract
This text tries to expose some of the central ideas of the Theory of Justice of the NorthAmerican philosopher John Rawls. First, I will examine the general characteristics of thetwo principles of justice; secondly, I will analyze how these principles are developed ina democratic state in what Rawls calls the “four-stage sequence”. Having exposed theabove, I will concentrate on two of those four stages: on the one hand, I will relatethe second of the four stages to the theory of popular constitutionalism (constituentpower), a central concept in modern constitutionalism. On the other hand, I will studythe last stage of this sequence facing the role of the judge in Colombia, specifically inrelation to the constitutional control of law. Finally, I will try to show how the receptionof the North American author has been in the jurisprudence of the ColombianConstitutional Court.
