Resumen
El objetivo de la presente investigación cualitativa será evidenciar si los pronun- ciamientos de la Corte Interamericana de Derechos Humanos (Corte IDH) frente a los derechos sexuales y reproductivos pueden configurarse como un elemento de discriminación a la población cristiana. Para ello se realizará un análisis de discurso desde una óptica crítica en cuanto a la interpretación e idoneidad jurídica de los pronunciamientos oficiales, las sentencias y las opiniones consultivas de la Corte IDH. El aporte teórico desde el que se enmarca el análisis es la teoría de la liberación, movimiento eclesial en clave latinoamericana que aboga por la liberación del oprimido de las estructuras de dominación e injusticia social. De este ejercicio, se constata la extralimitación dentro del actuar de la Corte IDH, a favor de la imposi- ción de su narrativa hegemónica frente a los derechos sexuales y reproductivos y la marginalización social del cristiano.
Abstract
The objective of this qualitative research will be to demonstrate whether the pro- nouncements of the Inter-American Court of Human Rights regarding sexual and reproductive rights can be configured as an element of discrimination against the Christian population. For the latter, a discourse analysis will be carried out from a critical perspective, regarding the interpretation and legal suitability of the official pronouncements of the Court, sentences and advisory opinions. The theoret- ical contribution from which the analysis is framed is Liberation Theology. Latin American ecclesial movement that advocates for the liberation of the oppressed from the structures of domination and social injustice. From this exercise, the breach of limits within the actions of the Inter-American Court is verified, in favor of the imposition of its hegemonic narrative in favor of the sexual and reproductive rights and the social marginalization of the Christian.
