Abstract
The use of artificial intelligence (ai) in armed conflicts represents a new paradigm for determining the role of companies involved in the creation, development, and supply of this technology for military purposes, in favor of the States. In that context, it is pertinent to analyze, through the international legal framework, whether businesspeople have responsibilities arising from the use of ai in war, especially due to the non-compliance with the principles and norms of international humanitarian law (ihl). Accordingly, this research is focused on establishing whether from the leadership position of those who make up the organizational structure of military technology companies and allow ai to be used in ways contrary to what is established in ihl,it is possible to incur the commission of war crimes that may be investigated and prosecuted by the International Criminal Court (icc), through the application of the extension of criminal responsibility. The above indicates the legal limits to which its applicability would be confronted.
